- Chapter 7 - This is designed to help individuals who make less the median income and have few assets. We explain how the mean test works, which is used to determine eligibility to file Chapter 7. To be eligible, you need to pass at least one of the two exam parts.
- Chapter 13 - Chapter 13 involves the use of a repayment plan, where the debtor makes payments to the Trustee for their secured debts and a portion of their unsecured debt. The plan runs 3 or 5 years and we counsel clients on the importance of properly budgeting all of their expenses in the plan. Late or missed payment to the trustee may result in your case being dismissed. Chapter 13 filings are often used to stop a mortgage foreclosure and you are able to pay mortgage arrears through the plan.

If you qualify for Chapter 7, you will be able to discharge all unsecured debts in about 90 days. This includes credit card debts, medical bills, and late rent payments. Lenders will be forced to stop proceeding with garnishment of your wages for foreclosures — if you continue to make your payments on time.
Chapter 13 will organize your debts into a three or five year payment plan and will stop repossession of your car or other property. After the plan is complete, any remaining debt is discharged.
